You need to write a proposal for our client to present at parliament for the change of the act of parliament. The proposal is about how to change existing parliament act to solve the bankruptcy and financial issues of citizen in Malaysia

i dont want anybody house,going for auction by bank

I dont want anybody declare bankruptcy because of Credit Card, Hire purchase

Point 1: Housing Loan -2-3 page

Current situation: Auction house cases has been increasing from year to year (please show statistics/figure/graph from Malaysia authority website). Banks had many non performing loan (NPL)

Proposed solution:

-Counseling department should be formed by bank to advise their client and help to resolve their financial matters

-Burden on legal cost and other relevant repossession costs should not be allocated to customers.

-Stricter criteria for loan approval (eg, fix loan tenure date increase until max 55 years),

-Agreement clause should be transparent (many unfair terms is stated in very small print in advantage of bank at the expenses of customer. Give examples on this). Discuss further how enforcement or change of act of parliament helps to solve this.

Point 2: Hire Purchase -2 page

Current Scenario：

Buyer can easily buy or own the car with no down payment or less strict rules

Proposed solution

-To buy the car, the buyers need to have 10 percent down payment with fixed tenure 5 years

-Repossession cost should be born by bank not allocated to customer (eg, for late payment, bank charge unfair legal fees/penalty fees。 This is because it will further increase burden of the customer.

Point 3: Credit card/Personal Loan - 1 page

Current Scenario: Credit card debt trend in Malaysia (please provide facts and figure)

Proposed Solution

-Better Customer management system with proper address/contact details. Many customers failed to get updated about their financial/loan status because change of address

-Increase criteria to apply credit card/persona loan (stated current criteria to apply cc in Malaysia and proposed a new criteria)

Point 4: Insolvency/Bankruptcy - 1 page

(Description of current clause, suggestion of area of improvement and modified clause)

Point 5: Bank Negara/banking institution - 1 page

(Current role of financial institution and Bank Negara, Weakness and area of improvement)

Point 6: EPF (Employees Provident Fund) - 1 page

Current situation: Account 2 of EPF is currently asked by bank to settle the outstanding loan to solve the customer’s problem

Proposed Solution

Account 2 only can used for down payment and fully settle. It cannot used to settle outstanding. (Please provide strong reason to justify the rationale to do this)

Conclusion - 1 page
